A Case Study of the Tort of Internet Defamation

Over the past five years, the Chinese courts have engaged in an unprecedented and massive effort to improve transparency, posting millions of court judgments online, making trials public via internet video streaming, and creating a fledgling case precedent system to promote consistency among different courts. Using a case study of the tort of internet defamation, this talk will show how increased online transparency is already transforming the way that Chinese courts decide cases, and what improvements still need to occur to ensure that this mass of new data is used in a way that creates fair outcomes for those involved in legal disputes.
